I am getting calls from a collection agency who cannot provide me with the orginal debtor and there saying ive made payments from 1999-2002,, but i dont recall, and they cannot give me any detail, what can i do,, and there is nothing on my credit report

Have they tryed to verify ss# previous address ETC? If they can not provide you with simple information you need to get their address and send them a formal CEASE and DESIST letter. Here is a sample letter that should help. http://www.creditinfocenter.com/forms/sampleletter7.shtml

Good that you've checked your credit report. If you don't remember a debt, and nothing in your credit report corresponds to what the agency is asking for, it could be a wrong identity.

Might be another person with your name has a debt, and this agency is just calling anyone with a similar name trying to collect. I believe the caller gets paid for getting money from someone, anyone. So the caller could be disingenuous in telling you he doesn't know who the original debtor is. It's in his best interest to say only that *you* owe the money.

Like others have said, don't send any money until YOU are satisfied it's your debt. And make sure the caller leaves his phone number.

And don't forget that it could be some sort of identity theft issue, too. Though if someone made payments for three years, that doesn't seem like an identity theft issue, more like a Negative ID thing. And it could be a simple scam- "You owe money. Pay us." is just a way to get money from you. If so, getting the phone number would be useful for your police report.

Tell them that you can only review this debt if they a) send it to you in writing and b) show the name of the creditor, the correct dates and the nature of the amount owed. While it's entirely possible that you do owe money (it hasn't been 10 years), who knows.

They bought the debt from someone real cheap. They are now beating the bushes to see if anyone will just pay up to get them to go away. This does not make the debt valid or enforceable.

1st. Get the name and address of the compnay calling.

2nd. Write them a letter and demand to know who the debtor is.

3rd. The burden of proof is on them, to prove that the debt is valid. Demand proof !

4th. The debt is to old to collect anyway, so dont sweat it.

And last but not least, even if you do owe the money DENY IT !

Sounds like a scam to me. Ask them for proof and until then don't pay!! One thing that will help. ask them for an address as to where to send your payment. If they cannot provide it or want you to do it on the phone you know it is a scam. call your local police dept.! go get em!

Ask them to send you something in writing. Do not pay ANYTHING until they can tell you the information you seek. It is your right as part of the fair debt collection act.

if there's nothing on your credit report, it could be a scam - ignore them. get the name and address of the collection agency and check with the Better Business Bureau or the business license dept of the city they work from and see if they are real. chances are they won't give you that info - sounds fishy if they won't give you who the supposed real creditor is

dispute and ask for verification of the debt. once challenged they are required by law to provide you with that information.
