In India, in case this mother is unemployed & not having any income to maintain herself she can seek maintenance from her son under section 125 of the Criminal procedure Code to avoid her destitute condition. Let me here bring to you notice that just recently Parliament has approved the Maintenance and Welfare of Parents and Senior Citizens Bill, 2007, which aims at protecting the senior citizens and makes neglecting parents above 60 years punishable by a fine and imprisonment or both.
Soon this bill will take the shape of Act & it will be helpful for such parents who are being neglected by their children, till that time this mother can take relief under the provision of section 125 Cr.P.C as mentioned above.

I'm not sure I understand the question. there is no law about sons being required to take care of their parents... ever... it is just a common curtousey that sometimes is shown if the sons love their parents. But it is not the son's job to take care of his mother...ever. That kind of thinking is crazy. What is the question about property law? If by the father being expired means that he has died... if he left a will and gave the son what the mother wanted, she can contest it, but most likely will lose anyway. Next time please be more clear about what you are wanting to know because this is very confusing and I am only guessing at what you might be asking.

If you mother does not leavea will, the property comes to you, if you are the only son. If you have other siblings, the property gets shared.

However, why is the son not taking care of the mother? If the son wants the property the least he can do is be nice his mother.

Normally, children have inherent love and regard for their parents. But it is sad that some will put up theirs just for the money.

I am thinking that there is no law, other then pure human decency and one of the ten commandments that say honor thy mother and father, saying that a child has got to take care of a parent.
If you find yourself in a situation where you need help and your son has turned his back on you, then I would go to the state and ask for help. Then the next time your son needs a hand, he would have to go elsewhere for it.
It seems such a shame that someone cannot be bothered to return the care and love from the very people that provided it to him from the first moment of conception. But if he can't, then he is going to be the only real loser.

if father has written will with regard to his property it will belong to those whose names arewritten in it.
otherwise till mother is alive she can avail her husband's property.
if son is a wicked person he will anyhow convince his mother for property.
son should understand that he is living just because of his mother.
if he is an idiot hen no law can do anything.
