Ok...so let me first off say that iam scared out of my mind. This is my first accident and OF course it has to happen the day before i change my insurance over. I was involved in a minor fender bender of which i took full responsibility for. The damage to her car was very minor. Mostly paint from my license plate frame and some minor paint job work and she was not hurt at all. I know i was wrong for driving without insurance...i know i made a huge mistake i'm just so scared that they are going to sue me. She is being really sweet about it so far but i'm calling her and her husband in a few minutes to talk about and could use some advice before i make the call. My insurance kicks in today but of course it wont cover it since the accident was yesterday and i can pay for it out of the pocket i'm just soooo soo scared that they are going to press charges or call the police on me. I'm not a bad guy just unlucky to get my sandal caught between the brake pedal and gas on a rain slicked road

Don't be nervous or scared. In a minor, weather related accident people rarely make out a police report. Usually they exchange insurance information and it's handled that way. Since your new insurance wasn't in effect until the day afterward, they're policy probably covered uninsured motorists. Call and give them your information, ask if they've gotten an estimate to repair the damage but do not go into a long, drawn out conversation about anything else. Get the name of their insurance carrier and their agent's name since that's who you'll have to pay if they've turned it in to their insurance already. If they haven't done that, then you will pay them directly and make sure you get copies of any receipts for the repairs. This will help you in the event they take your offer of payment and then turn it in to their insurance afterward and neglect to inform them payment arrangements have been made by you. Be calm and good luck.

I do not feel sorry for you one bit-no insurance should not have been driving- i really can not afford or do not want to pay for car insurance but I DO, now that i said that- call them up and tell them you want to pay for their car's damage out-of-pocket. You want them to go to an auto body shop, get an estimate and send it to you so you can send the a check. you can also make them sign something that lets you know they will no sue you in the future.

Well.. if you believe in god.. i suggest you start to pray.

Sure, they could be "good people" and get an estimate and you would have to pay out of pocket (please prepare- no matter how minor this could be hundreds or thousands of dollars) for that and a rental (yes, you owe them rental)

Or... they could go home... talk to friends... realize its a "graet idea" to get an attorney.. and sue you for an alleged injury... i see this everyday.

Sorry... you seem like a good guy... but people who drive without insurance have to understand they put themselves in this situation. You lucky you didnt kill a child or seriously injure someone or something- you could have potential ruined your entire life and be in debt for eternity.

I hope this turns out for you and i hope you learn a lesson here. I also hope people who think insurance is stupid read this and learn why you need it.

hmm this can be a pretty grey area, maybe you should talk to these people first , find out what the money may come to and tell them about your situation. they may be able to come up with a way to resolve this problem. i do not condone this idea but why not ask them if you can say the accident happend on teh day you got your insurance, again i do not condone this action mearly a suggestion.

Just relax..just tell them that your going to pay for the paint job on their car, it will cost you but I think that is the only way.. You did nothing wrong, except for wearing sandals while driving..

Try to work out a payment plan with them, and stick with it if they allow it. If they do turn you in, it could lead to a ticket or worse.

Good luck on your negotiations.
