are there certain warrants that require an officer to bring you into jail? If you are pulled over while driving and have a bench warrant are the cops required to arrest you? What about a warrant that is not a Bench warrant? Can the cops make the decision to arrest you for the warrant or let you go? Why do cops only arrest some people who have warrants?

There are different types of warrants to include Grand Jury, Writ, Capias, Probation, and regular Arrest warrants.

Capias and Writ of Arrests are essentially (without going into great detail) warrants issued by the court for things such as failure to appear...sometimes known as a Bench Warrant.

Grand Jury warrants are issued by a grand jury when sufficient evidence is presented to warrant an arrest.

A "regular" arrest warrant would be issued in a complaint either by a victim or the police when witnessing a crime themselves.

Because a warrant is an order from the court...the officer should make an arrest when confronting a suspect with a warrant. This is not always the case.

An example of where a warrant may not be executed by an officer would be if the warrant were for bad checks and the suspect was able to "pay out" immediately. The warrant would be immediately recalled once payment was made and no arrest necessary.

Any other time...if I see someone who I know has a warrant for their arrest...I'm doing the job I'm paid to do ... and somebody's going to jail!

The different warrants are: -bench warrants:The judge issues these when a subject doesn't appear at court on his given court date. -search warrant:When police have reasonable suspision that there are illegal drugs or wanted persons inside a house/car. -arrest warrant:These are most common.Any time someone has been charged with a crime and are not in police custody,they will issue an arrest warrant for this subject to be brought to jail. I have never heard of a blue warrant though.It's possible that these exist in only some states.

can I ask a ? in regards to the answers just given?????? Do these warrants and the rules of arresting or not apply to all states, or are they different in OR. vs. N.Y.
I was told that in OR. if you have a warrant and you get yourself on the docket for court to see the judge, the officers DON't have to arrest you, its their choice. So why would'nt they just give the chance to be responcible & go to court? Not ALL are huge threats to community.Can anyone reply ?
