My supervisor has failed to see that my instructions from the dr. is that i be on modified work (workmans comp) she jumped all over me when i tried to tell her this and since then i have gone ahead and just done my job as usual. however I have gotten worse and am know having physical thearpy and have missed some days of work due to my injury. does workmans comp have to pay for my days of work i have missed and what can i do about my boss not listening to me about the modified work thing.and am i in trouble for doing my job as always. do you understand what I'm trying to say.

I would suggest that you contact your doctor and your claims adjuster. As a work comp claims adjuster, when one of my claimants tells me something like this, I will always make a point to call the employer and tell them that the claimant should absolutely not be working outside of their restrictions. Doing so will only make the injury worse and postpone healing. Unless your doctor has taken you off of work for those days, you would not be owed any benefits. Another factor is the waiting period in your state. Some states have a 3 day waiting period, others have a 7 day waiting period. This means that you would have to miss longer than the waiting period to be owed any benefits. Good luck!!

You don'y say that you were injured on the job.
If so, Workman's Comp is involved, or should be.
If your work load is contributing to aggravation of your injury, Workman's Comp will not be very happy.
Has this been reported to their WC board?
You can contact them and your employer must furnish the information. She is flirting with a lawsuit.
If the injury is job related.

You must go back to the supervisor or to her supervisor and show them again, your Doctors instructions. She cannot legally ignore the Drs orders. Remember the National labor relations Board (In the USA) is there to help and protect you. When talking to the supervisor, I would be sure to mention (but not as a threat) the term "National Labor Relations Board". Just to let her/them you know you can go to them for help.

Report this right away. Are you in a union? If so, contact them. What she is doing is illegal and you don't have to tolerate it. Best of luck.
