He has to pay prior to the payday. Say it falls on a Monday, the banks are closed so he is required to pay the last working day that the banks are open and the last business day before the original payday.

In every State where I know the law, if a payday falls on a bank holiday, the boss can pay you on the next banking day.

Since Christmas falls on a Tuesday, if that's your payday, you can legally be paid on Wednesday.

If the company is closed on Wednesday, then he must pay you before Christmas, because it's only BANK holidays that defer paydays, not company closure days.

He can give you a check on Christmas day, if he wants to be silly about it. But he is legally required to pay you BY your payday (the 25th), so he can either pay on xmas day or before.

The bank being open isn't relevant, as the bank isn't the only place to cash checks.

An employer can pay you any day he pleases but only a S.O.B. would pay you after Christmas.
