DWI/DUI are considered criminal offenses everywhere in the U.S. There are usually indicators that alert an officer to believe a driver may be under the influence. Along with the DWI, the driver would also be cited for applicable traffic infractions.

It is considered to be both in most states if not all of them.

It's one thing that people can stop them selves from doing, yet they still do it and they end up taking innocent lives. Such a waste and such a shame.
