A business owner was paid over 12k to repair my Harley Davidson motorcycle. It has been over a year now. My Harley is still not done - lots of items left to purchase and install to this day. The owner does not have any assets - The repair is slow and no sure if it will ever be resolved. The Harley has a lean through Harley Finance. Do not know what to do?

Additional Info:
This person does not have any liquidity, he does not own much of anything, some items he had - have been repossessed from bank and he rents a house. He spent my insurance money on a deposit for a home he purchased for 196k and the house was foreclosed on 2 months ago. I fear the only thing I can get from a legal stand is a judgment and honestly he may hurt him with credit but does not replace my cash. The total pile of motorcycle parts - ins money and my out of pocket cash is almost 30k.

Do you have a contract for the repairs? An estimate? If it has not been fixed after a year, you might want to consider taking the business to court to get the bike and your money back. Check the website for your state to see if you could file in small claims court, although that ususally caps out at $5k. IIt might be time to get yourself a lawyer, and try to to get as much of your money back as you can at this point. If you have a contract or any singed document it will make it much easier, and less costly, for you to do so.

I would be tempted to get the bike and whatever parts and remove them from him. Then sue him for the difference. See what you can get out of him.
