I recently made a purchase on Ebay for 540.00 dollars. I used Paypal to make my payment but the seller stiffed me. Paypal will investgate the case but most of the time you never get your full amount of money back. I bought the item for and Xmas gift and now I am out 540.00. Can you take legal action against a seller? he is out of state BTW.

For $540 you would have to file your claim in small claims court, but you would have to do it in the city/state where the seller lives.

I suggest that you look into the rules for small claims court on the web page of the state where the seller lives, and see if there is any recourse for out of state suits.

Unless he can prove he shipped the item to you and you recieved it you will get your money back. I know this because I recently shipped out a stereo receiver through the mail with no tracking info. The person claimed he never got it and I had to refund the whole price plus the shipping. I looked at his feedback and this wasn't the first time he had claimed not to get something that a seller shipped. Anyway you will be fine...call paypal's support number (402) 952-8899. Even though things didn't turn out in my favor they were pretty nice and helpful. :)

no, sue in your state, make the seller come to you to object to jurisdiction. only one ny judge ruled jurisdiction was not correct, but that case is being appealed and many other trial judges in other states would not hold that way. facts are important. in you bought the item and the seller made a subsequent promise of any kind, sue for breach of the oral contract, fraud and misrepresentation in the inducement. there are arguements to be made for jusridiction being where you are. the ny judge erred in his decision and islikely to be overturned if the case is appealed.

ebay sucks.....i have been ripped 3 times now and ebay wont help and also no way to get ahold of them....they could care less and dont want to be bothered i will never send money again

well, of course you can. he Scammed you. so report it to the police or the higher authorities. its best if you called ebay and tel them the problem or case. The best is go to the police like queenstown or clementi, or any other police station.

go to police....would be way too hard to sue unless you plan to go to his state....
