Unfair does not equate to illegal. In an "at will" environment which is all states except Montana an employer may fire anyone for any or no reason! Long as it violates no law such as a protected class like age, race gender etc. This doe snot meet that criteria

How many times have you been late in the past? If you live in a right to work state they can fire you for really no reason at all. But no it isn't fair

If you are an at-will employee, yes. At-will employment gives your employer the power to terminate your employment at anytime. You can be late, you can call in and say your late, you can have red hair and your boss may not like it, you can still be fired for anything under at-will employment.

What does fair have to do with anything? They can fire you the first time that you are late. They can fire you if you're on time. They can fire you on your day off. They can fire you any time for any reason. It doesn't matter if it's fair or not, only if it's legal.

You KNEW your schedule, therefore you KNEW you were late. That is all the warning you are entitled to. I would bet you company required you to sign something acknowledging that you were given a copy of the employee handbook. I would also bet that handbook stated you COULD be fired without warning if you did not show up ON TIME for your scheduled shifts.

Is it fair? Yes.

Is it legal? Yes.

It is fair because you knew what time you were supposed to be at work. If they schedule you at 8am and you show up at 8:05am they shouldn't have to sit you down and say "now look, you've been late this many days". Why should they have to? Is it their responsibility to make sure you can get to work on time? No, its yours.

It is also legal because they do not have to write you up or talk to you about it. As long as you know what time you are supposed to be at work then they are covered. As long as they don't discriminate against your age, religion, sex, ethnicity, or disability, then they have done nothing wrong.

Depending on what state you reside in, you can be fired for being late one time. Sorry.

Yes. Most employment is 'at will', and an employer can fire you on the spot without a good reason.

In most cases (NOT ALL), an employer would not fire someone who is doing a good job! That would not make good business sense.

Do you have a history of being late? Just because you were not counseled it does not mean you were not aware of your actions. Not everything in life will give you an advance warning. lesson learned? Be on time.

Employers HAVE to tell you beforehand why they are seeking to dismiss you. It came up recently when my friend was facing dismissal. Many people have won dismissal cases where the employer has failed to do this. Have a google about, you'll find the info your need fairly easily.
