Ok. My mom and dad were married about 16 years, and they had 8 children. They got divorced, and now we live in NC, and he lives in NM. 4 of the children are over 18, and he is finally making child support payments because they take it out of his check. It's only around $700/month. He still owes my mom about $40,000 though, and I want to know if she will ever be able to actually get that amount of money. She barely makes it with the small payment that she is getting now, and if it were possible, that money could really help. There are still 4 minor children at home, the youngest is 11.

The only way she will ever collect this is to sue him in court for money owed her. Contact the agency thats currently garnishing his wages for details

Is the 700.00 a month his base pay or are there monies added for arrearages? If the $700 is just his base amount your mom should be able to go to court through your child support enforcement office (it may be called something different in your state) and get an amount tacked onto his monthly payments so he can start paying the arrearages. My hubby's ex wife pays an extra $50 a week toward her arrearages. She shouldn't need a lawyer for this...we didn't

if the child support is court ordered and he is finally making payments as a payroll deduction,regardless of the 40.000.arrearage he will be paying your mother that child support until the state is satisfied that his responsibilities are met.meaning,if all the children have reached 18,your mom will still be receiving c/s payments until has paid her in full,unless ofcourse he loses his job on the books and decides to work under the table.

well in the state of fla i had to pay all the back child and support 3000.00 in food stamps she recieved needless to say i was very happy to pay every cent i owed,, oh by the way this was because it took 1 year to get divorced
