While they were still together, he stole her debit card and spent $8,000. When they got a divorce, they went to court over the money he stole from her personal account, not their joint account. They mandated him to pay it, but as far as she knows, they didn't give him a deadline. Is there anything she can do to make sure that he needs to pay it? Or am is she screwed? This is in Georgia.

Common law state. This occurred prior to divorce. There is nothing she can do.
My step-father's first wife open up tons of credit cards while he was on deployment (Navy). She ran up 150K in debt and then served him with papers when he got back.
Through the divorce, she got to keep all the crap and a portion of his pension...and they had to split the debt.

A court order will not change this dude's friend's credit history. A court order cannot mandate him to pay, as he can easily appeal it (I gave an example toolshed...you think my step-father sat back and just took the beating. No. The judge ordered her to pay for it all, as what she did was mallicious and willful..and her attorney appealed it BECAUSE of COMMON LAWS.) Seriously!!

If she has a judgment/order for him to pay her back the money he stole from her then she needs help getting it enforced which is now a collections matter. She probably needs to talk to a collections attorney but I'd think they would want to get a wage garnishment order entered against him so the money just comes out of his paycheck. Good Luck.

If the court ordered him to pay the money, it does not matter that it happened while they were married or that GA is a common law state. There is a court order. She should discuss with a lawyer about how to collect.

I think she is out of luck because they were still together when he took the money.
