I was in a serious truck accident and charged with DUI, however, i wasnt drunk (I dont even drink alcohol), my workers comp rep told me he talked to the officer and said he charged me because he can "always drop it later, but cant add it later if I was drunk" all tests came back clean, etc. The charges are still pending (not dropped yet). This is stressin me to no end, even though I know I wasnt drunk, I cant sleep, I get nasaus, I cant stop thinking about it, my 14 yr old daughter looks at me like Im a criminal, and hypocrit, since i preach to her the seriousness of drinking and driving, even though I explained it to her, etc. I have to go to court again (2nd time), 2 hrs each way and is hell on me due to my injuries. Am i allowed to sue, and how much, the state of NJ for this unjust stress and embarassment they are putting me through?

No, but you are entitled to a trial.

Tell your daughter that the system is such that you are presumed innocent until proven guilty in a court of law, and everyone charged gets a trial.

Those are good lessons to impart under the circumstances.

Your attorney (you do have one, don't you?) can comfort you about the state of the case and its likely outcome.

If you don't have one, the prognosis is not going to be good.

the whole criminal justice system is a joke. that really sucks man, i feel bad for you. I actually think you will be able to sue the state once it is over. I would definately have an attorney go over some things with you. find one that will give you a free consultation.

That sucks...they are charging you with being drunk even though they can't prove it. That is why you are going to trial...to prove you weren't drunk which you have documentation about. You will win and the charges will be dropped.
