My spouses' last name is not legal. There is no record of adoption by the people he took this name of. Does that mean our marriage isn't legally binding?

Possibly.
The reason would be; the person you married does not exist; he physically does, but not under his (adopted name).
Which means if you took his last name during the marriage(the illegal one) then I would think that your marriage is not legal.
Both parties on the contract after you took his name. At that point they are not legal, which means the marriage is not legal either.

Not sure but I wouldn't think that the marriage would be legal if your husbands name isn't legal.

No it doesn't make your marriage invalid. As Sean Connery said in Marnie "You can sign Minnie Q. Mouse on a marriage license and you're still married".

I wouldn't think so. It just means your name isn't legal, if you took his last name.

no because it can be taken to court and then prison in some cases i've seen
