I am gong to verifiy this with the labor board, but I received the statement below from my employer. I was surprised that although my timesheet states "Overtime - 1.5 rate" my employer was only paying my overtime at the regular rate. I emailed them and this was the response:
Good afternoon. Unfortunately, the cut off for time and a half for is $27.50 an hour. If a consultant makes more than that amount, he/she is not eligible for time and a half and is paid straight time.
I'm sorry for any confusion about this. But that's also standard in the industry.
I read this: http://en.wikipedia.org/wiki/Overtime and I am neither an independent contractor nor a salaried employee. I am a W-2 hourly consultant. I'm going to call the Federal labor Board tomorrow, but wanted to know if anyone here has the scoop.
