I would like to know what I need to do to file medical mistake. Five months ago I had my ovaries removed, last sunday I passed a surgical sponge. It was horrible, I showed it to my husband and because it was so nasty and disguisting without thinking I flushed it. How can I prove this happened.

It would be better if you had the evidence, but you and your husband can testify.

Are you sure it was a sponge? Anyway, consult a lawyer.

You can consult a medical malpractice attorney.

BUT..... It will be a VERY hard case to prove.

A surgical sponge will normally break down completely in less than a month, plus if something was inside your uterus it would normally pass much sooner than that, plus it's going to be hard to persuade a court that something like that happened and you flushed it.

Don't be surprised if you can't get a lawyer to take your case. Apart from anything else, even if you CAN prove that it was left inside you, you have no damages.

A girl was raped a while back but the 2 guys flushed the condems. The investigators actually went into the sewer and got the evidence and through DNA was able to convict the two brothers.
Call a good attorney.

I'm assuming it was left in your uterus by accident. Did it come out of your woo woo? Unless you have serious illness as a result, or had to get operated again you don't have a case (because you have nothing to sue them for - they are just stupid).
Plus, you don't have any evidence either. If you have severe pain or a fever or something, go back to the Doctor again. I might call and report it to them or at least write a letter so there's a record of it.

Your question is about whether you can prove that the doctor made a mistake (i.e., committed malpractice). You may be able to prove it with your own testimony and with your husband's.

But even if you can prove that the doctor made a mistake, you'll also have to prove that you were harmed (i.e., damaged) in some legally cognizable way. It will almost certainly be insufficient to prove only that it was disgusting to look at.

Holy crap... that's really horrible. Call a lawyer, I think you can still get the b*stard. A lawyer will tell you what you need to do.
