Yes, by law, your employer should give you a lunch break AND a break.

no, but you can report them for unfair/unsafe work practices. there would be no point in suing. it would cost you more in court and lawyers fees than you make in a year. you should just ask your boss if you can take a 30 minute and a couple of short 10 or 15 minute breaks. or just ask if you can take an hour or 45 mins. their workday and break policy is most likely written policy that you agreed to when you signed you new hire paperwork. so there's nothing you can really do. if your boss won't give you a longer break and it means that much to you, quit and find a different job. some people don't even get a 30 minute break and work longer than 12 hours. your situation is pretty common.

Can you sue? Yes you can if you can find a lawyer to take the case.

Can you win? No. The employer isn't breaking any laws.

Suing would probably solve one of your problems though, you wouldn't have to work those hours any more since they'd probably just fire you, and would be within their legal rights to do so.

Look for a different job.

Sorry but you can't. Employers are not required to give 10 minute breaks, or any other breaks, for that matter. At least in the state of Indiana. And I believe that it's this way in all right to work states, which pretty much encompasses the entire USA.

You can NOT sue for this. There are no Department of Labor rules regarding breaks and lunches. This is totally at the employers discretion. OSHA has some regulations for hazardous jobs but they won't apply to a warehouse position.

Nope. Federal law does not require employers to offer breaks or lunch periods.

**Texas does not have laws requiring breaks or lunch. The same as federal law.
Find a better job if you're that miserable!

I doubt it unless it's a violation of your contract/terms of employment. This is the kind of thing that you should have checked on before accepting employment. If you're supposed to be getting another break and you aren't then you may be on to something.

EDIT:
A rational person would just cut back their hours or get a different job instead of fishing for a settlement for a mess they got themselves in to.

You are supposed to be allowed a 15 minute break for every four hours you work. I don't know that you can sue but you can report them to your state/county labor department.

It's illegal methinks, tyalk to the employer or your union. I don't thin kyou could sue unless the employer denied you more break time after raising the issue

In the U.S. there is not Federal Law regarding breaks and lunch periods. There are some state laws, check your state labor laws.
