Yes, your insurance company will win that lawsuit. It is irrelevant whether the damage was intentional or accidental. If the neglectful act of a tenant caused damage, they can be successfully sued for recovery of the damages.

It depends on your policy. You stated that it is a homeowners policy, do you have a rental clause?

Not all policies will cover the property as a rental unless it is stated in the policy. Policies that cover rentals are usually a little more expensive. This tends to be a probloem when people convert their home to a rental or do not specifiy that it is a rental when obtaining insurance.
