My friend bought a car b4 her and her hubby got married, she doesnt drive, and the car was bought for them to use together but put in her name as he had a bad credit rating.
They since married, and have now seperated. He is refusing to give the car back. Can she legally call the police and have it returned as it is in her name, or will it need to be part of the divorce proceedings as she bought it with the intention of him driving it.
We are in the UK.

As long as she can prove the car is in her name ie, registration document, then YES, she can definately get the car back.
Ring the police, and tell then the car is hers, and has documents to prove it, husband has got it refusing to give her it back, and they will go see him, and evenually she should get the car back, and maybe took to court for stealing the car in the first place.

Weither you are in the UK or in France, ... The best thing to do is go to the police, the statement that they make there can be used in court for the divorce!! This is a good thing for your friend party. They have prove that he's "bad" so they may give her more things.

In a divorce battle its all about the good party and the bad one on the other hand. So now, because of the police statement, they can see her as the good side. The whole process is very complicated but the basics are everywere the same. Make sure you have enough prove so you will look as good as possible in front of the judge.

Of course this doesnt count when you divorce as "friend", waw no law battle. But still first police statement is important in the both cases!!

Some people on here can give you wrong advise and then you may act on it and it is all wrong..

Ok just because the log book has your name on does not mean its yours.
You need to show the police evidence you paid for the car and it’s in your name.
Once you can prove you and you alone paid for it then you can report it as stolen.
And the police will act they have to.

Your only 19 weeks. you have a while to go maybe just wait a while. YOu dont have 2 decide a name now. Some babies go a week without a name. Maybe once you have had the baby and you have had a few days to get to know the baby your husband and you will agree on a name.

If she is the only one on the deed. The car is hers by law. Divorce proceedings are a different issue.

not sure how it works over there, but in the states, all she would have to do is call the cops and report it stolen. the car is in her name and she brought it into the marriage, so it would not be part of the divorce settlement.

why does she want the car back if she can't drive? is this a point scoring exercise. When me and my ex split up l told him to keep the lot to get rid of him.Let him and the car go.

She should just go and take it from him and when he tries to take it back call the police and report it stolen. If it is in her name she has all the legal rights to it.

You need to check the laws in your area. In the US it would be community property. Belongs to both of them. The police would most likely tell her just that.

she can DEFINATLY call the police my partner is in the same position and got his ten grand car back!
if its in her name for definate and she can prove it then he can get done for stealing it
