I bought a cake from my local market, even thou it came in a box, she put it in a carrier bag. It got damaged on the way home on the bus, after someone bumped into me. I rang the bakery and they refuse to exchange it or repair it for me... whats my rights?

I feel like crying, it was this stupid drunk man that pushed me, and the corner got bumped. I didnt check it at the time. I got home to discover it had caused the icing to come off.

The local market is not at fault. Just buy some icing and repair the cake yourself. Then make a little joke about it when you unveil the cake. Lighten up - this isn't that serious and can actually be a funny story.

QUICK! Call the cake police!
You have the "RIGHT" to buy another cake, fix the one you have or do nothing. Why is it that people are always looking to blame somebody else for their actions? The bakery sold you a cake which was in perfectly good condition when you left the premises. You chose to take that cake on a bus. People and things get jostled around on buses. You should have taken better care of your cake.

Once you left the store with the cake in good condition, the store had no control over the situation, and the only rights you have are to be certain that you hold cakes from the bottom so they aren't destroyed on the way home.

when the cake left the shop it was fine. Sorry but you were at fault technically as you damaged it on the bus!
It is not the bakery's fault that someone was clumsy on the bus is it!

EDIT
That is so bad hun. Maybe you could patch it up by trying to ice where it got damaged? You could ring the bakery and see what they could suggest you do to try and rectify it?

You've been watching too many episodes of Judge Judy. I've seen a few hilarious attempts at litigatious liability pursuits, but this one takes the biscuit. It really is the icing on the cake.

Well it wasn't the fault of the people that sold you the cake.

The issue here is with the person who bumped into you, even though it may have been an accident.

There is no responsibility with the people who sold you it whatsoever.

I seriously doubt you can expect the bakery to exchange it for you, as they were not the ones who damaged it. I'm sorry to tell you this, but even though it wasn't you who ruined your own cake, the bakery still considers the damage YOUR fault.

They aint gonna pay for someone bumping into you and your Cake are they......?

Its like saying "Give me a new Cake cos I left this one in the road and it got run over"

I am truly sorry you asked this question, all you will get are recriminations as you are either serious or joking.

In the case of being serious, well you were most likely the youngest child of many and were doted upon. As for joking, well, in that case it is pretty funny.

It was in your possession when it was damaged. The bakery has no responsibility after you accept possession of the goods. Sorry.
