I'm not a lawyer. If you want an educated response then you should talk to one. They usually will counsel you for free. I'm also not a doctor or a nurse. Again, if you want an educated answer then you should talk to one. Every story also has two sides, yours and the doctors. So while they may or may not have treated you and your daughter correctly I only have the information you've provided to go from. Personally, no, I don't think you have a strong case. The fact that your daughter had to have open heart surgery was very stressful to her body. The medicine used in general anesthesia is very stressful, even for an adult! Plus the fact that they probably had to circulate her blood through a machine while she was under and other factors could contribute to her delay now. The doctors probably wanted to wait to see what was wrong with her as her body had just been through something very traumatic and while they may or may not have treated you with the respect that you deserved or needed at the time, they are there to do their job which is help your daughter. The fact that you don't really even know what caused her complications in and of itself damages your "case" right there. In a court of law you need to prove your case beyond a reasonable shadow of a doubt. I'm hesitant to even say that the "diagnosis" of failure to thrive isn't entirely accurate. Like SIDS we don't really know the cause and just give it a fancy sounding name. There are things we just don't know about. I'm also unsure of what a neurologist can really tell you about a 9 month old. Again I'm not a doctor, but a 9 month old can only do so much. When did you have her checked? If she was older, like 8 or something and all of this goes down, then you might be talking about something differently. Again, not a doctor, but while the left side of your brain is responsible for words, language, logic, shapes, etc it also controls the right side of your body. So it really may be a failure to thrive situation. As far as bedsores, she may not have been able to have been moved. If she was moved too soon or too quickly she may have torn stitches both externally AND intetnally. That would not have been a good situation. And the simple fact that she isn't saying much... That could just be her. All kids develop differently so you really never know what is around the bend! Also, a Christian, I don't like the use of God as a shield then you blasting the doctors and nurses with hatred. You should be thankful that God did save your child and has blessed you with a healthy daughter who could have died. God never gives us anything more than what we can handle. He can also see through the telescope of time and knows that this issue of your daughter's will bring Him glory in some way. Wouldn't that be a great testimony if your daughter were healed of this? Or despite this she goes on to become a doctor herself? God uses these everyday "tradigies" to help us focus on Him!

When you get an anesthetic, you are intubated when the doc puts a plastic tube down your airway to ventilate you. When he takes the tube out, you are extubated.
