As suggested by many of the people above change of name by two National newspaper publication & Gazette of India publication, affidavit duly attested by the Public Notary or class 1 magistrate is sufficient for changing the name in the Indian Passport etc. As far the educational certificate is concerned since these cannot be changed now & therefore, the affidavit duly attested by the Public Notary or class1 magistrate regarding change of name along with these educational certificates/degrees/diplomas all these should be first Apostilled by the Ministry of External Affairs at CPV Division, Patiala House, New Delhi to be used for any foreign transactions like issue of visa etc. These all documents have first to be authenticated by the designated agencies in the State from where the document has been issued. In case of personal documents like birth certificate, marriage certificate, affidavits powers of attorney etc, Home Department/General Administration Department are the designated authorities. In case of educational documents certificates/diplomas/degrees etc, State Governments have now opened Regional Authentication Centers (RACs) at various States from where the document should first be attested. Documents attested by these authorities then need to be presented to MEA for issue of Apostilles. Once these educational certificates & this affidavit regarding change of name are properly apostilled you can use them for your US visa purpose. This the latest legal position with regard to use of any personal or educational certificate for any foreign transaction including seeking visa on the basis of these documents. Once these documents are properly apostilled as told above there won’t be any objection with regard to their authentication from any foreign agency including US immigration department.

Yes the U.S. consulate will except this provided you can proof that you are both Sunil Dutt and Sunil Joshi.

The passport in your new name will be fine for the latter but for the former you will need as much evidence as you can such as:

- Your birth certificate with name change notarized and/or other officially signed documentation to show you have changed your name from one to the other.

- Any old photo IDs you may have - student ID, drivers license, old passport etc.

- Also bringing bank statements, bills, payslips with your old name and address on also would help.

Affidavit declaring that the different names on the passport and educational certificate is the same person is the remedy for your situation. Execute an affidavit and have it stamped by a notary public.
