My wife and I send money each month for their support. Can I legally claim them as dependents? They are Philippine citzens and do not have US SSN's.

Sorry, you CANNOT claim them.

1) They don't have US Social Security Numbers, and you have to list SSN's for each dependent you intend to claim.

[IRS Publication 17, Page 27, 4th bullet point under Introduction Section: "Social security number (SSN) requirement for dependents — You must list the social security number of any dependent for whom you claim an exemption."]


2) They fail to meet the residency requierment.

[IRS Publication 17, Page 28, Table 3-1, third bullet point: "You cannot claim a person as a dependent unless that person is a U.S. citizen, U.S. resident alien, U.S. national, or a resident of Canada or Mexico, for some part of the year."]

If they come to US and live for a certain period of time, they can apply for a tax number and you can claim them as dependents. They don't need to have SSN.

Dependents must be residents of the US, Canada or Mexico.
