Depends - if the car is traveling legally down the road way and a pedestrian steps out in front of him when he's just a few feet away - probably not. Because the pedestrian is at fault for causing the accident.
If the driver is drunk - and mows down a bunch of pedestrians who are legally crossing in a crosswalk (while they have the green hand that says it's ok to cross) - driver probably will go to jail.
This is not a black and white area. It all depends on the circumstances involved.

well it depends on a lot of things were there witnesses did the driver of the car call 911 was the driver of the car intoxicated has the driver ever been in jail for a felony there will be a hearing probably jury and its pretty much up to them but if 911 wasnt called and there was no police report there is a good chance the driver will do time

You need to define your question:
Was the driver drunk? Yes
Was the pedestrian in a cross walk? And had the right of way? Yes
Was the pedestrian drunk etc and just stepped into traffic? No
It all depends on the circumstances.

It depends. Was the pedestrian in the cross walk? What color was the light? Was it dark out? How were they dressed? Was the driver drinking? Was the pedestrian drinking. Lots of dependencies on this one.

Depends. Was the driver intoxicated? Was some other circumstances, other than mere negligence, involved? Typically, if you cause an accident, you don't get arrested as most moving violations are citations. However, you can get charged criminally for some type of conduct. Not necessarily. It depends on extenuating circumstances such a weather conditions eg. sun in the eyes etc. If it was intentional, chances are they will go to jail. If it was an accident and there was no malice, then the judge may impose a non-custodial sentence
