I have just recently filed a claim on my insurance (uninsured motorist). My truck was totaled at $23K. Last night a drunk driver hit the car parked next to mine, totaled that one and in turn that car wrecked my truck. The drunk driver totaled his camero and ran off last night without being identified. More than likely he will be identified, but I assume that he does not have insurance. I dont want to file another claim because I assume my insurance will stick it to me hard. What can be done either through legalities or other car insurances?

i used to be a claim adjuster. If you have collision on your own policy, your insurance should cover your damage, and record this file as "third party hit and run". It's up to the insurance company to go after the drunk driver for the money back. You're not at fault in this case, so your premium for next year will NOT go up. But you should go get a police report as soon as possible if the damage is over 1000.

If the car that caused the damage can be located - you can file a claim against that person's insurance company.

You can't sue someone if you don't know who they are.

Your only option is to file a claim against your insurance policy or suck it up and take the financial hit out of pocket. Your agent my be able to give you an idea of how an insurance claim would affect your rates.

Well, the other car isn't at fault for the accident. If this guy has no insurance (I agree with you, it's not likely), then the ONLY option is to sue him. You'll likely get the judgement, in six months or so, but you'll ALSO likely not get any money.

This is another uninsured motorist property damage claim, if your state has that coverage, or a collision claim, if they don't.

It doesn't matter. You have an obligation to notify your insurance carrier of ANY losses (it's in the policy) so don't risk non-renewal or cancellation because that will REALLY get you stuck hard.

frst off , get a police report, go to your insurance agent and show it and explain the situation, if he saay's your rates are going to be affected, go to another reputable ins agent. you should not be held responsible, if you were not in the vehicle when it got totaled.
