my brother went to jail because he didnt pass the polygraph test .someone stole his tv from his house,they think he did it.there is no insurance on it so he is still going to have to pay for it.is it legal to arrest someone for not passing the test,he chose to take.

Polygraphs are not admissible in a criminal case, you will not go to jail. There must be more to the story.

So he was arrested for filing a false report. Near and dear to my heart. Read my profile. A crime must have a motive. There is no motive if he had no insurance. Sounds like a money making project to me - for the state. They DO use the information in the polygraph tests against you - just not in court. A jury will never hear it, but you can bet the bank that the cops and the DA and everyone who is sitting around deciding his future saw it. That's why he was charged.

All evidence gathered during a polygraph test is inadmissible in court. That means that even if he did "fail" the test, the jury would never know about it. Why would the police think that he stole his own TV?

There is something you are not telling, or have not been told. You CAN NOT go to jail for failing a polygraph test. That is a fact of law.

There is far more than you are telling and probably far more than you know. I know you want to believe your brother, however I suspect he is not telling you everything.

There is no criminal charge for "failing the polygraph". He was arrested for something.
