I hope someone can please help. Today i received a summons to appear in court due to a incident involving my dog. I am to appear in court in less than 72 Hours. I find this very little time to prepare a defence case or at this time possibly even find a good solicitor, also work commitments could be a problem. Is a person not legally required more notice before a case? As i said the first i knew of it was at 3PM Monday & i am due to appear 10AM Thursday.

Call your courthouse and talk to the court clerk.

I would think you have no choice in the matter.

Where I live, if you don't appear, they put out a warrant for your arrest.

There is no specified warning period for a court appearance, a court can demand your presence within hours of a hearing.

If you know what the summons relates to, it could be argued that you have had time to prepare a case and should have been doing so in the event of it coming to court.

One option open to you would be to contact the courts and ask for an adjournment to prepare your case, it may well be granted.

In theory you can be presented with a summons and taken straight into court.When you attend the court you simply say you are not prepared to go ahead with your defence and ask for the case to be adjourned to another date.

At least they are giving you notice. A few years ago I got a summons to appear as a witness (to something I did not see). The day before the accused pleaded guilty but the clerk did not bother to contact me, and it cost me $700 in lost wages. Be lucky you are getting notice!!!!!

You can be summoned within 24 hours you are going to answer how you plead they have to prove your guilt you can get a solicitor at the court

You refer to a summons - so the form will give you the option of adjourning in your absence if you deny the charge.

it is probably because there is evidence your dog is not being well cared for, and time is of the essence in getting the dog proper care.

explain your situation as best you can, and you may be able to get more time, or get the dog back after it is healthy again.

turn up ask for an adjournment to prepare case.that will give you 28 days if your lucky.
