Tickets do not normally just get dismissed. I wouldn't count on it. It seems to me losing control of a vehicle and crashing into a tree would certainly be unreasonable.

Getting a lawyer is your choice, and will cost more than the ticket. Normally, I would say it is still worth it to save an insurance hike, but the accident will be on your record, and your insurance has to pay a claim anyway, so the ticket probably won't matter.

The officer asking you how fast you were going will not help the case at all, and your answer can be used against you.

No, the ticket will not get dismissed. I don't know the exact law in your state, but here you can get what is called a careless and imprudent driving ticket. This ticket is often given when people are traveling "too fast for conditions" or in you case at an unreasonable speed. The citation is used when the officer cannot determine an accurate speed for you vehicle. You could have lied to the officer and said that you were doing 35mph, but the same ticket would have applied. Anytime you run off the road and strike a tree, you were going to fast for those particular conditions at that particular time. It doesn't matter if you were going 5mph or 100mph, your still lost control of your vehicle because of excessive speed.

I agree with the above, the ticket probably will NOT get dismissed. You were driving too fast for the weather conditions which is why you went out of control.

The speed limit is speed limit in ideal weather, dry, clear skies, not for rainy, wet weather, so the speed limit sign doesn't really apply here.

You needed to use better judgment for the weather conditions. Its not about the numbers here, because even driving 10 mph under the ideal weather speed limit was far too much.

If you hydroplaned you were traveling at an unreasonable speed. It was further evidenced by your losing control of your vehicle and crashing in to a tree.

The fact that your insurance paid changes nothing on your ticket.

purely in view which you have been below the fee cut back does no longer mean which you weren't traveling at an unreasonably extreme velocity. I run into this concern in lots of situations with newly-authorized drivers who think of that the published velocity cut back is a license to force at that velocity. The choose will could return to a determination no rely in case you will have your license lifted. one thank you to confirm which you lose your license is to mindset this with the mindset that your velocity ought to no longer have been unreasonable in view which you have been using below the fee cut back. you may convince the choose which you quite and actually do comprehend which you may force at a smart velocity consistent with each and every of the circumstances, consisting of climate, time of day, and your individual wellbeing to force. it quite is undesirable sufficient that now, your automobile coverage will develop into prohibitively costly. you purely theory it develop into ridiculously costly previous to now. After this accident, whether the fee ticket is disregarded, your provider will non-renew you, putting you into the assigned possibility pool, meaning you're watching everywhere from 500% to 3000% advance interior the top rate for criminal accountability coverage. various judges will extraordinarily plenty right away convict in this actuality trend, which in lots of states potential that the license is revoked and you will could pass for the duration of the written and street exams back after your 18th birthday. In some states, you would be precluded from taking the attempt and getting a license for a minimum of an entire year. it won't be a foul theory to get a criminal professional so which you will strengthen a negotiated plea and probably shop your license.

In Florida, if there are no independant wittnesses... 9 times out of 10... a ticket resulting from a traffic crash will be dismissed. Really depends on the state... and judge/hearing officer.

I think you are guilty of "failure to maintain reasonable control" of your vehicle, not speeding. I'd fight the speeding but chances are the prosecutor may have it amended to failure to control or something similar.
