im 16 almost 17 in feburary 2008. i want to get emancipated but i know my mother and stepfather wont allow me. my real father doesnt have custody but would like to get me emancipated says it can be doen secretly and by him. is there any way for me to get secretly emancipated like this?

I don't believe he can do that for you, the whole point of emancipation is to show that YOU are able to take care of yourself, not that you would rather be taken care of by your father than your mother. And it is not something that can be done in secret as you need to prove to the court that you can take care of yourself and your mother can provide testimony against that.

you can't be secretly emancipated. You have to go to court. When you are emancipated you will no longer be under the control or care of either of your parents.

How are you going to take care of yourself? Where will you live? How will you pay for it?

Would it be possible instead to live with your father or another relative? You are old enough to decide which parent you want to live with and unless your father is dangerous, the courts wouldn't keep you from him.

(if your mother's home is not a safe place for you to be--this next bit of advice doesn't count)
If emancipation isn't right for you and you can't live anywhere else except at your mother's, then you will be 18 soon and can move out then without any problems. Just keep saying to yourself "I can tolerate annoying, I will be 18 soon". Then start planning how and when you will leave and start saving money to care for yourself when you do go.

If you live in the US (it may be different in other countries) he's very wrong. Emancipation must be granted by a judge. The judge will not grant it unless you meet all the requirements for it (you didn't give any details about your situation, but most kids don't even come close to meeting the requirements) and your mother WILL be notified.

Pretty sure you can't do it secretly (unless you are in imminent danger or something, but even then it wouldn't be a secret) and to be emancipated you have to prove that you're able to financially take care of yourself completely.

Not sure if it can be kept a secret or not as your mom has legal custody. But it can be done as my Brother and His wife just got their grandaughter emancipated from their daughter.

I'm pretty sure the only way to get that done is by going to court and having a trial. Its not done secretly.
