I know parents who do this but I'm wondering if this is against the law. The New York State Compulsory School Attendance Law states that a child who is 6 by a certain deadline MUST enter first grade. I am assuming that there are exceptions. I don’t understand why. If the child is having difficulty, they will qualify for special education. It's not like the child will be in special education forever. They can be declassified. They can still go to the best college.

I meant is it legal to take a child out of first grade and just have the child be placed in kindergarten. The parents is taking the child out of first grade and NOT homeschooling them. Instead they are placing them in kindergarten in the school district.

Almost all children have a bit of trouble adjusting to first grade. They are away from their caregiver, whether that be mother, father, or nanny, twice as long during the day as kindergarten. Unless the child is actually retarded then I think the parents are doing the child a disservice in holding him/her back! As far as the legalities are concerned, I think you would have to check the laws in your particular state and school district.

I live in Missouri but my granddaughter didn't even start kindergarten until she was 6 years old. When she went to be tested at 5 the school recommended holding her back a year because she wasn't ready. Kids mature at different times. If a child isn't ready then it is better to give them that extra year or they will feel like they are behind all their classmates. And as far as special education, remember a child that young is very impressionable. You need to be careful about giving them a low self esteem. A parent knows their child better than anyone else. And I think between the parent and the school system they are qualified to make a decision on whether to hold a child back or not. As far as your state law, what happens if a child doesn't pass kindergarten. Do they force them into a grade level they know they will fail at? I don't think so. I think they just want to make sure that all children are enrolled or being homeschooled by age 6.

The only way the parent can remove them without making arrangements for Home schooling is by re-enrolling them in KG. A child not being ready for 1st is basically a hold back whether the parents reemove the child or the school recommends it.

You said the parents haven't taken him out of school they have moved him back a grade into kindergarten. Obviously they didn't feel he was ready to be promoted to a higher grade. A lot of times ( with boys especially ) they aren't emotionally ready. Why wouldn't be legal to what you feel is the best thing for the child?

I don't think it's illegal to take the child out of first and put him back in kindergarten. Each state has different laws, so maybe they should talk to an attorney first!

Yes the child can be removed from 1st grade and placed into kindergarten.

It shouldn't be. The parents know their child the best and if they feel the child needs to repeat kindergarten, they should be allowed to make that choice.

I think the paretns know the child. It may be illegal, I am not sure. But if they delay a year, that should be fine

where i live all kids age 5 and up are required to be in some form of school public private or home school,
