Is this incident war crime in your point of view? ........ Some give their opinion that it was a simply civil war. Is in a civil war, military get permission to kill such large scale of human being and rape children, girls, women in the name of property or encouragement for war? I'm a Bangladeshi and I would like to see that the perpetrators of the 'war crimes' of 1971 in Bangladesh are tried by a competent court.

However, I strongly oppose the people who are taking cover of this 'war-crime' issue now when there is a caretaker government (CTG) entrusted with the job of preparing the nation with its related infrastructures and logistics for holding a free and fair election by December 2008. We all know that what led to this situation and who are pulling the string of this 'war crime' issue to destabilize the CTG so as to give it a bad name.

By the way, our CTG has just started enforcing "Birth Registration" with local authorities as a mandatory practice for its citizens. Recently with the introduction of computerized "Voter List" with pictures and other information incorporated, we may hope to have some kind of "National ID Cards" soon, which is not a big issue in any other countries of the world.

The issue of holding free & fair general election was the cry of the politicians who were holding the nation hostage at their whims by enforcing blockades and strikes right from October to December 2007 and till 'One-Eleven'. Now the same groups of politicians have shifted their priorities from 'general-election' issue to 'war-crime' issue, which could have been dealt well by an elected government.

We have waited for 36 years now and these politicians were very much in power and never uttered a single word about holding trial for the crimes committed by Pakistani forces and their cohorts (Bengali) in Bangladesh from the night of 25th March in 1971 till 16th December 1971.

No criminals could get away with their crimes, no matter how many days or years has elapsed. See how they are rightly hunting for the Nazi and such war-criminals even after about 60 years of their offence? Please do not get me wrong. I hope you post this question in early-2009 when the present CTG would handover power to an elected body who as per the rule of the land can pursue this war-crime issue.

In my personal opinion a war crime should only be a crime that is in Violation of the Geneva Convention. also here are the facts about the 1971 Pakistan Military.
In 1971 the self-appointed President of Pakistan and Commander-in-Chief of the Army, General Agha Mohammed Yahya Khan and his top generals prepared a careful and systematic military, economic, and political operation in East Pakistan (now Bangladesh). They also planned to murder its Bengali intellectual, cultural, and political elite. They also planned to indiscriminately murder hundreds of thousands of its Hindus and drive the rest into India. And they planned to destroy its economic base to insure that it would be subordinate to West Pakistan for at least a generation to come. This despicable and cutthroat plan was outright genocide.
After a well organized military buildup in East Pakistan the military launched its campaign. No more than 267 days later they had succeeded in killing perhaps 1,500,000 people, created 10,000,000 refugees who had fled to India, provoked a war with India, incited a counter-genocide of 150,000 non-Bengalis, and lost East Pakistan.

My intellect and mind tells me you are an Anti-Pakistani Troll!!!

Your facts are way off 3 MILLION killed by the Pakistani Military!!!

Care to back the claim up, with some real evidence??

Both sides have been involved in some serious incidents but it has not been all one-sided and not all deaths during this time were caused by the military.

I dunno, Is using women and children as human shields to fire on our troops from behind a war crime? Thousands of Somali's and Insurgents have done just this and WE get in trouble if there's collateral damage(even if they are shot BY the Somali's/insurgents!!!)
I would say yes to the above, but there's no way any international tribual will take action.
Oh and for those who want a "Bush is a war criminal" answer, you may get it; but not from anyone in a position of authority on the issue. Fact is that if Bush is tried, then the entire UN Security Council has to be tried as well, along with the heads of state of most UN member countries(Everyone forgets that the UN used us as "enforcers" for failure to comply with UN resolutions in the beginning.)
