if my son is only going to be 11 weeks can i still claim him? the 501 irs publication says they must live with you for 6 months out of year. does this apply to newborns?????? or just children from single homes?

If your child was born on Dec 31st you can claim him. Your child will need a social security number by filing Form SS-5 with the Social Security Administration ASAP before the April 15, 2008. If you do not obtain the SSN by the filing due date, you should file Form 4868 for an automatic extension. Your new exemption is worth $3,400 for tax purposes.

For children who are born (or die) during the year, the 6 month requirement does not apply. They are presumed by law to have lived in your home for the entire year. IRS Pub 501 also explains that.

The 6 months doesn't apply to newborns. The rule for a newborn is that they lived with you from the time they were born, except for their time in the hospital. So yes you can claim him as long as you meet the other rules.

Your child could be born on December 31 and you could claim him for the whole year. The six month rule applied to children who are around for all 12.

Even though the child is 11 wks old your still able to claim that child because he's your responsibility, so the answer is yes you can claim him you pay his doctor bills, clothing, diapers and etc... and when you do claim him, file head of household and earned incom, so you'll get more back!! plenty back and with the child being an infant you'll definitely get what you deserve
