Someone turned into a shopping center right in front of me and I had no time to stop, although I braked as hard/fast as I could. Cops happened to be around taking donations and one saw the whole thing and said I was not at fault. Someone at work told me no matter what my rate would go up. I'm with State Farm if that matters. thank youu:]

Any time you file a claim against your policy - there is a chance your rates will go up. Rates vary from state to state. So there is no one set of rates that governs all areas. Your agent may be better able to tell you how your company will handle your rates in this situation.

I don't know that Y!A is the best place for getting the RIGHT answer to this. I would think you'd want to talk to someone in the business. I'm from PA and have spent plenty of time in Jersey and I've heard that NJ is a no fault state too but I wasn't sure whether the source was credible. I've also heard the auto insurance rates in NJ are ridiculous already as it is so I would hope for your sake that they won't go up.

To the best of my knowledge, NJ is a "proportional comparative state" meaning that if you are 51% at fault for the accident, you cannot file a liability claim against the other party's insurance.

In your case, since a police officer was a witness and if you have the police report stating it was not your fault, you can try and file a claim thru the other driver's insurance instead of filing a claim thru your own insurance.
