My boyfriend filed for emergency custody of my child and the judge denied his request because I showed a birth certificate without a fathers name. however he has her physically and the police will not get her because they say as far as he knows he is the father. What do I need to do to get her back.

a lawyer and a blood test. if the blood test comes out he is the father then you will have to fight to get her back, if itt comes out he is not the father you can file for kidnapping, you can also so over there with a male friend and take your daughter back. I dont understand how the cop could say that he cant do anything when there is a certificate that is blank where the fathers name should be!

Unfortunately you are going to have to file for custody yourself. If the judge denied him custody its a given that custody will be given to you but is he the father and why did he take the child to begin with? Most states say that until someone files for actual custody that no one has it so even though the child is obviously yours it doesnt mean you automatically have custody. Get a lawyer and fast!!!

You need to talk to a lawyer or the judge involved who ruled on your case, he/she is the only one who can give him and you a court order stating that the custody of the child be returned to you. You will have to take this court order to the police and they will get your child for you.

I think u should go to ther maury show do the blood test thing and prove hes not the father. also if that doesn't work u should call it a kidnapping isn't that was it was. and go over to where he is nd take her back.

Bring him to court. He doesn't have any proof that he is the father unless he gets a dna test. But you have a chance of getting your daughter back.

take the birth certificate to the police and let them see it then press kidnapping on him

If you have evidence that this guy isn't her father,call the cops and get him in jail for kidnapping!!
