Alright, I just found out that I owed taxes for two years (2003, 2005) and they are going to small claims court. I have found the W2's just a minute ago and they were not turned in because I thought they were my copies and believed that the payments were taken care of. I guess not. Since it has been taken to this point, can I just go in and file now (go to the office give them the w2's) or do I have to wait for court? I would rather get this done and over with BEFORE that. Please let me know ASAP.

Worried.........

I work (preparing taxes) in a city that has income tax. We deal with this all the time. Typically, if you call whatever entity collects the tax (sometimes the city, sometimes a regional authority), they will allow you to just file. As long as the money gets paid, they usually won't follow through with going to court. It's cheaper and easier for them to take your check and forget about it than it is to actually go to court.
Remember that if you filed with a tax prep company, like H&R Block, they should help you out with this. They deal with it all the time, and it is part of the service you pay for. If not, feel free to email if you have further questions.

There's something a little strange about your account - governmental bodies don't normally take people to small claims court.

But that said, if you found the W-2's and they show payments of withholding that the city didn't take into account, you should talk to them on Monday and try to get it straightened out, not wait for the court date in whatever court it is.

Good luck in getting things straightened out.

In most cases you can go in before to make payment and avoid court. But each City is different with different by laws. So it depends. I have no fear that you can go in a pay early. But there maybe a fine plus interest due as well.
Good luck.

OOOoops!
Call and explain what happened, and tell them you want to take care of it.
There's a 99.99% chance they'
ll tell you come come in and straighten it out. and you'll be able to avoid court.
Good luck.
PS. Now's a good time to start on 2007 taxes. Get a folder, and put the stuff in it as you get it.
