Not sure of the legalities but my friend was knocked down by a car 4 years ago. He was uninsured..she is still waiting compensation.

It's nothing to do with the highways people or the council unless there was a defect in the road or pavement which caused the accident (which there wasn't, by the look of it).
Quite correct, don't use the no win no fee shysters, go and see either the CAB or a solicitor (most will give you the initial interview fee). There are compensation schemes which may be of help. You might want to try looking up the Motor Insurers Bureau yourself. I hope he's better very soon.

Telephone any solicitor it will be free to talk to them. But I know when you are in a car accident there is a group, called the mib. Basically all the insurance companies are involved in this (why insurance is so high). They pay when a driver wasn't insured. Altough you would think the police would do what us tax payers pay them to do and catch the offender. Here is a snippet from their site -MIB was established in 1946 as a private company limited by guarantee for the purpose of entering into agreements with the Government to compensate the victims of negligent uninsured and untraced motorists. I hope your son gets better and things work out, he deserves some sort of pay out. Try even running mib through the internet search engine and see if you can come up with something. have a very merry christmas

Hi there, the police should be able to give you the name and number of a special insurance scheme that is set up for innocent victims like your son in law.There are so many little scrotes driving around with no insurance, that if they ever hit you or your car you could not claim as they obviously did not have insurance.People got fed up with this as it was unfair that the victims had to pay for the damage,so the goverment set up the insurance scheme to give us all some hope.Good luck to you and your family.

What you are really saying is: How can he get some money out of the ratepayers who are in no way to blame. There are too many money grabbing vultures around as it is. However, if the injuries are serious enough he may be able to claim from the Criminal Injuries Compensation Board.

You say pavement so I assume you are in the UK?
There is a slush fund set up by insurance companies for issues such as this.
Report to police and then see a solicitor who will take it from there.
He is right in not wanting to use "no win no fee" as they only take cases that you could win yourself without a solicitor!
Hope he is feeling okay and it hasn't ruined Christmas.

UK - Criminal Injuries Compensation Board, sorry dint know the address. Several years ago ex husband was involved in a hit and run accident and we claimed, it took about 2 years to sort it out but he got 2500.00 - he spend the night in hospital with cuts and bruises and was off work for a months.

You did not ask what you really want to know. I think you are asking if the Road dept can be sued for theh damage to him. If this is the question, then probably not as they were not the proximate cause fo the collision. The driver of the hit and run vehicle is responsible and unless found, your personal health insurance shouldl cover expenses.

i've hit two deer.. ran out in front of me both times. they each got up and ran away after. and i've ran over a cat. they are just like squirrels. they stand in the middle of the road and run from side to side like they don't know which side to go to until it's too late.

Were there any witnesses?? He should get compensation one way or another with hospital reports to back him up. Perhaps the local Citizens Advice Centre could advise him.
I do hope he is making a good recovery.
