I guess I did not make myself clear. The person is from the UK and here in the United States on some kind of Visa that requires them to leave every so many months for 6 weeks.

Every time this person leaves it HAS to be for at least 4 weeks and the last time it was for 6 weeks exactly. There must be some other reason. Also, she is pregnant with my child and I even went to Mexicot with her this past summer for 10 of the days of the 6 weeks she was requried to be out of the United States. I guess bottom line is that if I don't marry her she will have to keep leaving and then coming back

Our baby is due in Jan. 08 and will she be able to get some kind of extension to stay in United States to deliver her baby and possibly extend her stay. My divorce is hung up because my wife left me to go back to Spain about 2 years ago. So I am having a hard time getting my divorce final to marry this woman.

Sounds like you would be on a non-immigrant visa for somewhere outside the EU and Norway, Sweden, Switzerland etc. Canada maybe?

Visitor - anyone who enters the U.K. as visitor/tourist has a maximum stay of 6 months before they must leave the country, however there is no requirement they must leave for 6 weeks.

If they are U.K. or EU citizens then no visa is required regardless of their length of stay or the purpose of it.

Also other citizens of non-EU countries such as the U.S., Australia, New Zealand and Canada etc do not require visas either if they are coming to the U.K. as tourists.

He may be in the states on a B1 businees or B2 tourist visa. It is good for 6 months, Then the person must return home. however, there is n rule about how long they must stay there...this person probably just chose the 6 weeks.

If they are from England then why do they have a visa? They should have no need for one. Sounds a tad dodgy to me.

Umm... idiots, why the thumbs down when it is bloody obvious FACT that someone from England does not need a visa to live there. Are there Americans here?

I think it's more to do with tax issues than a visa issue. That's why rock stars move out of England - the tax is extortionate. Leaving and coming back is basically a tax dodge.
