My 22 year old son is in the National Gaurd Works PT and goes to school. He has been living on his own for 2 years and the military pays his tuition. My X give him NO financial help. How can my x husband continue to claim him as a dependant?

He can't, legally, for several reasons where he doesn't meet the requirements. If your son also files a return and claims himself, your ex has 100% chance of getting caught. Otherwise, he still might get caught. If and when he does, he's going to be paying back a lot of taxes plus interest and possible penalties.

You ex can continue to claim him simply by putting his name and Social Security number on his tax return. This may not pass muster if your son claims his own exemption. I suggest your son file his return as early in the year as possible and use Form Zero (that's blank paper) to attach an explanation to his return stating that he believes his father claimed or will claim him as an exemption but is not entitled to.
