She was charged with driving under the influence, possesison of class c drug, criminal tresspassing, and phone harrassment.

What do you think she will get!
She is not my friend, I am the one who got the warrant on her for telephone harrassment and criminal tresspassing.

We live in Tennessee, and she is 20. I think she might be on probation, but not for sure. She does have a record.

What do you think will happen.

Also, to prove the telephone harrassment, I recorded out phone conversation on the cell phone. It doesn't record my voice just hers. I told her I was recording her and she said "Record, record, record, Bi***"
Do you think that will hold up in court?

The judge will likely see the corelation between her criminal behaviour and her drug use problem. So long as she has a drug habit, she will always exercise a blatant disregard for the laws of society. Eliminate the drug addiction, and you see people change into law-abiding citizens. If its a hanging judge ( I hope not), she'll do jail time, probation, and detox program. If its a sympathetic judge, she'll get community service, detox program, and probation to monitor her progress.

A lot will depend upon any previous criminal record. With or without a good lawyer all the charges will probably be lumped together and there will be a plea bargain offered. She will probably just get probation and the only jail time she will get it the time already served when she was initially arrested. They will most likely sentence her to drug court where she will have to jump through hoops for the the remainder of a suspended sentence. This will include periodic drug testing, 12 step meetings etc. If she blows it by not reporting in as required they will issue a warrant and pick her up. Back to jail. Then another chance. The revolving door effect. I'm not kidding you. But if she bothers you while she is on probation, she will get violated. They try to rehabilitate. If all else fails then she will probably get perhaps 1 year in jail.

All of these are separate unless they prosecute them together. the DUI could land her about 7 days jail time if its her first. the drug charge, again if its her first may land her a 30 day term or simple probation and drug program (probably the ladder). Phone harassment is a simple misdemeanor charge and will land her probably probation. If they prosecute all together I would say maybe 30days county time and a couple years probation and some sort of treatment. If she has a good lawyer she may just get probation and drug/anger management treatment.

Telephone Harrassment? I get that all the time from some guy named "Frank Smith" with an Indian accent. She should be locked up for a loooong time.

it depends on past record... over crowded conditions at jail... the judge... how many other dui"s she has. i would like to think probation is out... and jail time for dui is in... in some states like ohio,.. she is doing time for dui. whether it is three days.. or 30 plus. also depending on how many times she has had dui... she might lose license as well. if she is already on probation that is not good. pv.. probation violations are really frowned upon by judges.. these days. unless she has a really extensive record.. she is NOT going to prison.

You probably shouldn't have told her you were recording her. Because that's all she said, which wasn't really harrassment.

With possesion of a drug she can deffinatly go to prison. On top of the other offences she will be in a cold dark cell for a long time.

I'd say lesson learnd and move on! you gained half of what you were owed not including overdraft fees by your bank. However at least you received some compensation.

It might depend on how good her lawyer is and how much she cries on the judge's robes. However, as a repeat offender, she most likely will get jail time or rehab time.
