i want to file chapter13 but i want to keep my income taxes they want to take my car now but i need it. or will they take 2008 taxes can i still file now.

good luck filing bankruptcy.....it's a lot harder now than it used to be.

You didn't say who "they" are taking your car away (repo man from the dealership? your cousin who you "borrowed" the car from? the IRS?).

Regardless, you are pretty much screwed (sorry, but I don't like to sugarcoat things like this!), as "they" are not going to wait for your 2008 tax return (what does that have to do with anything?) or bankruptcy (note the spelling!) hearings, which could take forever. Even if you managed to get a court injunction, you said that "they want to take my car NOW", so I presume it's too late.

The only thing you can do is to file for bankruptcy,
but that isn't going to get your car back.

you probably advise will they take your tax refund.
