Doesn't that give all the other soldiers the right to treat people however they want to and teach other soldiers not to report harrassment and God only knows what else

because the investigation is still ongoing and further testimony may be required.

They may be holding someone from deploying because they may have to testify in legal proceedings or be prosecuted in one and looking at administrative or punitive actions against that person. That sometimes happens and each case is handled individually and the determination made on whether or not to deploy the individual.

Perhaps that person needs to stay state side to finish the proceedings of that harrassment case?

I'm not familiar with the facts of this case. Are you sure it wasn't blocked for the course of legal proceedings?

What are you talking about? Why would someone not do it if that meant not going to Iraq for a year. Think about it! You really make no sense.
