We have already given our personal statements to the insurance co. concerning a personal injury claim. They have also taken statements from the general contractor and was putting the framing contractor on notice and that they also needed his statement also. This was about a month ago.
I have requested an updated on the claim but have not received anything yet. How long should I wait and what is the procedure of what takes place next? What are they doing?

OK, an attorney is going to take 1/3 of whatever you get, AND you can be pretty much guaranteed that the claim won't settle for at least a year if you get one.

Next up, statements from the framing contractor. All the adjusters have to get together. They're going to want copies of your medical bills, and likely your prior medical records, depending on what happened and what you're claiming. The adjusters are probably fighting - the GC vs. the Framing adjuster - about who's going to actually do the settlement, and how much each of them will pay.

It's not unusual for this kind of claim to take about 6 months to settle. Keep in mind, THEIR insurance company has NO duty of good faith towards you, you are NOT their insured. Plus, we've got the holidays coming up.

Still, depending on what you're asking for, I would NOT bring an attorney into this unless they flat out deny paying anything to you, or are offering you a silly low amount. It WILL slow down the claim, and cut your payout.

If you have a PI Claim and you don't have an Attorney, you are at the mercy of the insurance company. Not good for you,very good for the insurance company. Sorry.

They are stalling. Insurance companies have claim money invested and every day that they can delay a payout means more interest income for them.
