If she is a babysitter. You would need a 1099. She would be an indemendent contractor and she would not pay taxes right away, but at the end of the year.
If you want to take takes out of her check, then you need to have a company to higher her under.

Your state is irrelevant. You can not write off taxes you pay for household help including a babysitter (or your cook, gardener, butler or the upstairs maid.) Their wages, if over $1,500 for the year are reported on Form 1040, Schedule H (as in Household.) If the babysitter provides childcare so you can work, you can claim a portion of it as childcare credit. Household employees wages are subject to Social Security and Medicare but not income tax withholding and matching by the emploeyr and are reportable on W-2.

If your babysitter does the work in your home, then the booklet for you is IRS publication 926. You should have been paying her on a W-2 and withholding the appropriate payroll taxes if you paid her more than $1500 during the year.
The W-2 is due at the end of January (you need to get your EIN before then).
If your babysitter does the babysitting at her home (especially if she does it for more than just your child), then we're looking at a 1099-misc.

Does she come to your home, or babysit at her home? If she comes to your home, she is most likely a household employee by law - search irs.gov for info on that, plus you'll have state requirements also. You'll take out taxes from her paychecks, and pay employer taxes.
If she babysits at her own home or at a center someplace, then you just both have to keep good records of what you paid her - she'll file a tax return showing that amount, and you can claim the credit. You'll need her social security number for your return.

need to keep track and do a schedule C that is a form of self employment or you can contact a payroll company and have your checks done thru that, I dont know alot about it but its not hard to get started, just have to do a little homework
