The owner of the vehicle is responsible. If a police report was not filed, call the police asap and file a report. Then file a claim with their insurance company.

If you have collision coverage on your own policy, I would suggest letting your own insurance handle the claim for you, and let them try and go after the at fault parties. They would have more luck than you.

Herin lies the rub. An accident on a public roadway requires insurance, reporting the accident and payment of damage. In most states such an accident on private property is not covered by any traffic laws. Your recourse then is to file suit. Say it's Fed Ex or UPS, I think you can find a good lawyer to launch a winning case for about $8000. Short of that and assuming the police won't file a traffic accident report, you're out of luck. If you have $500 damage that $8000 lawyer will get you the $500 in all probability. But your net loss will now be $7500. And I have known of similar damage in shopping center parking lots by 3rd parties. You simply accept the loss. And in some obscure place these companies post signs stating they are not responsible for teft, damage or injury on their property. A fairly acceptable escape clause though not morally.

If the delivery truck owner/driver doesn't want to pay, you either collect through YOUR insurance and let your insurer sue them, or YOU sue them directly, for your damages.

No, the employer isn't responsible. The driver or owner of the truck that hit your car is, however.

This is a matter for your insurance company and the owner's insurance company to work out. Don't try to cut a deal with the owner. You might get screwed.

Did you get a police report on the accident?

If so I'd recommend you call your insurance company and theirs to let me know that an accident has happened. They should be able to handle everything for you.

Probably, the employer's insurance would cover it. You could file a claim directly with them.
