Like others said, mandatory only for transport aircraft, but the way technology is going more aircraft will have some sort of recorder. For example some EFIS systems sold for homebuild aircraft have non volatile memory which can be accesed post flight and could be useful in acccident investigation.

No. Only aircraft engaged in FAR Part 121 flight operations (scheduled airlines) are required to have FDRs and CVRs (Flight Data Recorders and Cockpit Voice Recorders). These are not required for private aircraft.

Only commercial aircraft need to carry them. And even then I think there's a certain limit, small charter aircraft may not need them.
