The person that hit you CAUSED YOU TO HIT THE PERSON IN FRONT OF YOU. So the person that hit you is responsible for all damages. You were stopped, even if you were only 3 inches from the person in front of you, you were stopped... You were hit, causing your vehicle to move, AFTER you had controlled the situation (and stopped), and they pushed you into the person in front of you. You are not at fault.

This is correct, you are talking about 2 separate collisions. First collision was the car hitting you from the rear. The second collision was you hitting the car in front of you. If you had kept the proper distance between your car and the car in front of you, the second collision wouldn't have happened. Why should the insurer of the car that hit you from behind be liable for the car in front of you, because you were following too closely?

It's going to depend on the standards of fault in your state. NORMALLY, the last guy in pays for everything. In a few states, your liability pays for the car you hit, you pay for your front end damage subject to your collision, his insurance pays for the damage to your rear end.

Bottom line: You're going to have to sue him to recover the costs. Keep in mind, his insurance company isn't going to pay out more than the policy limit, anyway.

Everyone is making guesses. Not being there and seeing exactly what happened makes it impossible to say. Most normally the vehicle causing the collision is responsible for all damages resulting from the crash. Was any determination made by the police ? I would ask for a copy of the report and go from there. I would also have your insurance look into it on your behalf.

This depends on the situation, on how far were you from the car in front, and how fast was the other guy going. However, if he was fast enough to shove your car into the car in front of you, he must be going at a pretty good clip. I'd argue with your insurance agent and let THEM argue with THEIR insurance agent. That's why you pay for insurance.

Yours is a simple solution: Just use your own collision insurance. Your company will then collect the policy limits from the other company and then may go after the person to collect the rest. You need to speak with your own insurance company ASAP. A $10,000. liability limit seems low. Are you sure that they have such a low limit? You say you have a lawyer. Why hasn't he advised you what your options are....??????? I'd fire the lawyer....

ANY time you rear end another car... for any reason, even if it is someone else's fault- you are liable. You have to maintain a safe distance between yourself and the car in front of you at all times. If you were more than two car lengths behind you have maintained a safe distance. If that is that case and you can and should appeal with your insurance company. However, if you were closer than two car lengths you have no recourse for appeal.

The car that hit you is responsible for your damage. You are responsible for the car you hit since you were following too close, and your insurance will handle that. If that car hit someone else, his insurance will cover, all the way up to the first car in line who isn't responsible for anything.

the guy who rear ended you is liable to fix your rear end. you rear ended someone else, you are liable to fix that persons car and your front end. it seems unfair i know, but thats how it is. you should ALWAYS keep enough distance between you and the car in front of you (even when stopped) to prevent this. I am surprised the guy in front of you has not made you file a claim for his car. sorry....you will have to claim on your policy!

The guy behind you is not responcible for your front.
You should have been far enough back to prevent a chain reaction.
Your insurance will have to pay for your front the rear of the car in front of you.
