My husband and I have custody of our two grandchildren, and have had them since February, and we are going to file them on our income tax. The trouble is that their parents let the other grandparents file them last year and feel that they are going to try to do it again this year. What is the earliest date that we can file our taxes so that no one else can claim them?

The earliest date for a paper return is Jan 2. The earliest date for e-filing is Jan 11.

If you are entitled to the exemption, claim it. If you e-file and it is rejected for the children being claimed on another taxpayer's return you'll have to file a paper return. In that case, the IRS will contact both taxpayers and ask either for an amended return OR proof of your claim. The IRS will then determine who is entitled to the exemptions under the law using the proof provided. The other taxpayer will get a bill for the additional tax due due to the loss of the exemptions.

You can file by mail as of January 1, or efile in mid-January. If both sets of grandparents claim them, the IRS will send letters to both of you saying that one of you has to file an amended return dropping the claim - if nobody does, the IRS will investigate and make the determination. Since they lived with you for 11 months, the other set of grandparents does not have a legitimate claim to them, so theirs will be disallowed.

It doesn't just go to whoever gets in first, although if the other people efile and get in first, you'd have to file by mail.

The earliest day is January 2nd I believe. www.irs.gov should help answer your questions on this. If the other grandparents also file for them there will be an investigation that could hold up a refund, you may want to try calling the other grandparents to make sure they are not going to file for them. it looks as if 1/9/09 will be the earliest day to file for 2008.hopefully u will have a w2 by then because without a w2 u are unable to file until 2/15/09.

You can file anytime, but it's a good idea to wait until you receive your W-2s and interest statements, otherwise you might have a mistake you could avoid. Also you won't get any tax refund until the IRS receives all income statements from employers.

As far as being first to claim the children, I don't think the IRS looks at it as a race. I would think the IRS would trigger an audit for all involved and determine who is worthy of claiming them on their taxes (i.e. who took care of the children for most of the year.)

It would be better to work it out amongst yourselves without the IRS determining it.
