if it was only a misdemeanor and proven not guilty?

Seriously I'm not in the military... I promise I'm not talking about myself.. could someone just give me and idea please?

A rape charge for anyone in the military if found guilty can include even a death sentence. This I dont believe is ever awarded but life in prison is. If found innocent it should have no effect on his service. If the person is not in the service and is found innocent it should not effect thier joining and if the person was a minor at the time they were found innocent the military more than likely will never know of the charge.

Rape in the military is not a misdemeanor.

If found not guilty, then nothing will happen to the service member

the UCMJ States

"920. ART. 120. RAPE AND CARNAL KNOWLEDGE
(a) Any person subject to this chapter who commits an act of sexual intercourse with a female not his wife, by force and without consent, is guilty of rape and shall be punished by death or such other punishment as a court-martial may direct.
(b) Any person subject to this chapter who, under circumstances not amounting to rape, commits an act of sexual intercourse with a female not his wife who has not attained the age of sixteen years, is guilty of carnal knowledge and shall be punished as a court-martial may direct.
(c) Penetration, however slight, is sufficient to complete either of these offenses. "

It is not a misdemeanor.

And if proven not guilty, then no penalty would apply. The entire record of the matter would be expunged.

If the accused was found not guilty, there are no military implications unless the accused was in an unauthorized absence status at the time of the alleged offense.

Rape if proven can be a ground for dismissal for someone who is in the military.

If the person was exonerated it shouldn't affect military service. They would not take them with a conviction though.

Even if found not guilty the charge will tarnish their reputation, obviously. Seen it happen...

Not guilty is not guilty.

No implication for future service.

they would have pretty much no chance.... it is a moral issue and most branches will just send him right back out the door.... way to much to explain here
