If that's the case we wouldn't whistle to stop a deer - instead we'd waive our arms at it to get it to run before we shoot. That's stupid.
Hey, it's smart hunting and I do it on all birds if I can get them to cooperate.
As far as the law goes, it varies by state.

,This isn't the practice of a serious duck hunter There is no rule against shooting a " sitting duck". If you are hunting with a good retriever the dog may be able to stir the birds to flight.

In Louisiana its legal but cannot speak for other states. If you are hidden well enough for them to land then your doing your part as a hunter. Just remember, shooting them on the water is actually harder then in the air because the bb's have to penetrate the birds wings witch will shorten your effective kill range. You can always gamble on a head shot tho.

Like the guy up there said, not usually illegal, but frowned upon. Kinda like shooting quail or pheasants on the ground, or turkeys out of trees or with a rifle.
