yes they can but they only do that during like kidnappings or felons on the run stuff like that

Yes and it can be done legally. However, cell phones broadcast the signal and your conversations may "bleed over" on another receiver. Cells aren't secure so if you want to keep your call private try another system.

As a 'tap', I don't think so. Phone taps are rare.
However, law enforcement can get 'pen traps' on phones and determine who you call, when, and exactly your location when you called, and in some cases, where you are at any given time.
